The troubled actress was freed shortly before midnight after posting $300,000 bail, an L.A. County Sheriff's Department spokesman said Saturday.
A judge rode to Lohan's rescue last night in a surprise ending worthy of a Hollywood script.
Los Angeles Superior Court Judge Patricia Schnegg cleared the way for the starlet's release from jail on $300,000 bail just hours after another judge tossed her in the pokey without bail for flunking a drug test.
The last-minute twist came after Lohan's ace lawyer Shawn Chapman Holley filed an appeal arguing the "Mean Girls" star was unlawfully whisked away in handcuffs following a morning court appearance.
"There is no question that Ms. Lohan is entitled to bail while her alleged probation violation is being adjudicated," Chapman Holley claimed in her lightning-fast writ of habeas corpus.
Schnegg agreed, ruling that Judge Elden Fox overstepped his authority when he stripped the relapsed redhead of her $1,200 sandals and had deputies haul her away in handcuffs.
Schnegg said California law guarantees defendants bail in misdemeanor cases and set bail along with some stringent conditions, including a new booze-monitoring SCRAM anklet - the actress' third.
Lohan's bail bondsman said earlier in the day he was prepared to spring the "Mean Girls" star with bail as high as $1 million, so her release appeared imminent.
"I was surprised. In my 20 years, I don't think I've ever seen no bail for a misdemeanor," David Perez said after Fox's surprise ruling.
Lohan, 24, was ordered to court because she flunked a recent drug test with cocaine in her system, a source told the Daily News.
The alleged dirty test, which came just weeks after Fox released Lohan early from in-patient rehab, will be the subject of a probation violation hearing set for Oct. 22.
Fox earlier warned Lohan that any missed or failed tests would result in 30 days in county jail.
By withholding bail until the hearing date, Fox essentially sent Lohan to serve the 30 days before any formal finding of violation.
"May I be heard?" Chapman Holley asked moments after Fox said he wouldn't grant bail.
"Nope," he replied, telegraphing his lack of patience with Lohan.
A mug shot released after her 10:30 a.m. booking showed her downcast with black-rimmed eyes and plumped-up lips, in an orange jumpsuit.
"She was very cooperative, very demure. It was a smooth booking process," sheriff's spokesman Steve Whitmore said.
Lohan admitted her relapse on Twitter last weekend, saying she was ready to face the consequences.
She spent 14 days in jail over the summer for missing alcohol education classes and then served 23 days of a 90-day inpatient rehab sentence.
Friday, she was back in a segregated cell at the Century Regional Detention Facility in time for a lunch of peanut butter and jelly.

Well at least I will be able to sleep tonight. Now that I know Lindsay won't have to stay in jail.
